Terms and Conditions NEPTN®

Conclusion of the Contract
The presentation of products on the NEPTN® website does not yet constitute a binding offer. By placing an order, the customer submits a binding offer to conclude a purchase contract. The subsequent order confirmation sent by NEPTN® does not yet constitute acceptance of the offer. The contract is concluded either through a separate order confirmation or through the delivery of the goods. NEPTN® will confirm the order no later than 14 days after the customer’s offer. The prices include statutory VAT.

Payment Options
Payment is made in advance to our account.
Payment by advance can be made either via PayPal or credit card.

Right of Return for Consumers
For consumers, meaning natural persons who conclude the contract for a purpose that is not attributable to their commercial or self-employed professional activity, the statutory right of return applies, which we explain as follows:

Right of Return
You can return the goods received within 14 days without giving any reason by sending them back. The period begins after you have received these instructions in text form (e.g., email), but not before the goods are received by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and not before we have fulfilled our duty to provide information according to Article 246 § 2 in conjunction with § 1 Paragraphs 1 and 2 of the EGBGB, as well as our obligations according to § 312e Paragraph 1 Sentence 1 of the BGB in conjunction with Article 246 § 3 of the EGBGB. Timely dispatch of the goods or the return request is sufficient to meet the deadline. You bear the direct costs of returning the goods.

Custom-made products are excluded from returns.

Return Consequences
In the case of a valid return, both parties must return the benefits received, and any benefits derived (e.g., usage benefits) must be surrendered. In case of deterioration of the goods, compensation may be demanded. This does not apply if the deterioration of the goods is exclusively due to their examination, as would have been possible in a shop. In addition, you can avoid the obligation to pay compensation for deterioration caused by the intended use of the goods by not using the goods as your own property and refraining from anything that could reduce their value. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of the goods or the request for return, for us with the receipt of the same.

Retention of Title
The delivered goods remain the property of NEPTN® until full payment is received.

The buyer is obliged to inform us immediately of any third-party access to the goods delivered under retention of title.

Defects / Warranty
The statutory warranty provisions apply. The warranty period is two years and begins with the delivery of the goods. The NEPTN® warranty terms apply.

Severability Clause / Applicable Law
If individual provisions of the contract or these Terms and Conditions are wholly or partially invalid, the validity of the remaining provisions shall not be affected. German law exclusively applies. UN sales law is excluded. If the customer is a consumer, the mandatory consumer protection provisions that apply in the state in which the customer has their usual residence shall apply, provided that these provide the customer with greater protection.

Legal Information for Consumers
We are not subject to any special codes of conduct. Any input errors when submitting your order can be identified in the final summary and corrected with the “BACK BUTTON” before submitting the order.
